Terms of Service

1. Acceptance of Terms

By accessing or using BuilderHub (the "Platform"), operated by MyKey Consulting Services LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.

2. Description of Service

BuilderHub is a residential construction project management platform that facilitates collaboration between builders, homeowners, and subcontractors. Features include project dashboards, messaging, document management, budget tracking, photo logging, checklists, and more.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use the Platform.
• You may not share your account with others or create accounts on behalf of others without authorization.

4. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable laws or regulations
• Upload or transmit harmful, offensive, or fraudulent content
• Impersonate any person or entity
• Interfere with or disrupt the Platform's operations
• Attempt to gain unauthorized access to any part of the Platform
• Use the Platform for any purpose other than legitimate construction project management

5. User Content

You retain ownership of all content you upload to BuilderHub (photos, documents, messages, etc.). By uploading content, you grant us a limited, non-exclusive license to store, display, and process that content solely to provide the Platform's services. You are solely responsible for the accuracy and legality of the content you upload.

6. Project Collaboration

When a builder creates a project and invites homeowners or subcontractors, all invited parties gain access to project-related data as configured by the builder. You acknowledge that information shared within a project is accessible to all authorized project members. The builder is responsible for managing project access and permissions appropriately.

7. Subscription & Payment

Access to BuilderHub may require a paid subscription. Subscription fees are billed in advance on a recurring basis. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change pricing with 30 days' notice.

8. Intellectual Property

The BuilderHub platform, including its design, code, logos, and content (excluding user-uploaded content), is owned by MyKey Consulting Services LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform without our written consent.

9. Disclaimer of Warranties

BuilderHub is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be error-free, uninterrupted, or free of harmful components. We are not responsible for any construction decisions, financial outcomes, or disputes arising from use of the Platform.

10. Limitation of Liability

To the maximum extent permitted by law, MyKey Consulting Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may cancel your account at any time. Upon termination, your right to access the Platform ceases immediately. We may retain your data for a limited period as required by law or for legitimate business purposes.

12. Governing Law

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Montana.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the Platform. Continued use of BuilderHub after changes constitutes acceptance of the updated Terms.
